OPINION

NYE, Chief Justice.

This is an injunction suit instituted in quo warranto by appellant, State of Texas, through its county attorney pro tem, the Hon. William L. Morrow, against appellees, the Hon. Steven N. Fischer and Juvencio Salazar. This appeal concerns only the State’s suit against appellee Fischer.

The State’s suit sought to have appellee declared not to be the Democratic Party nominee for the office of Willacy County Attorney. The suit alleges that according to Tex.Elec.Code Ann. § 141.001(a)(5)(A) (Vernon 1986), appellee is ineligible to be a candidate on the 1988 Democratic…
