This decision is concerned with two cases that have been consolidated for appeal. Plaintiff-appellee, Charles E. Call (hereinafter plaintiff), is the Chief of the Division of Reclamation of the Ohio Department of Natural Resources. The Attorney General of Ohio initiated this matter on his behalf, representing the people of the state of Ohio, in the Court of Common Pleas of Fulton County.
