The defendant, Steve Ohley, was tried by jury in the Circuit Court of Madison County on an indictment charging him with the crime of unlawful delivery of a controlled substance. He was found guilty and was sentenced to the penitentiary for a term of not less than one nor more than three years. On appeal defendant contends that his right to a fair and impartial trial was abridged by virtue of the fact that defendant’s Motion for a Bill of Particulars and Motion for Discovery were denied and because six tablets of the controlled substance in question were destroyed when the State performed…
