By these actions, plaintiffs sought recovery of the insured value of four ships from defendants “marine risk insurers” and “war risk insurers.” This Court entered judgment in favor of all defendants. The Court of Appeals for the Second Circuit affirmed with respect to the “marine risk insurers,” reversed with respect to the “war risk insurers,” and directed this Court to enter judgment in favor of the plaintiffs against the “war risk insurers.” Those defendants then brought this motion for a new trial under Fed.R.Civ.P. 59(a).
