STATEMENT OF THE CASE
This ease comes to this court on a motion to dismiss an appeal brought by the City of New Haven, Indiana (the “City”). Chemical Waste Management of Indiana, L.L.C., Chemical Waste Management, Inc., Waste Management, Inc. and WMX Technologies, Inc.
