RULING ON MOTION TO DISMISS AND MOTION FOR SUMMARY JUDGMENT

DRONEY, District Judge.

The plaintiff, Neil Ellis, brought this action seeking injunctive relief pursuant to 47 U.S.C. § 401(b) against the defendant, Tribune Television Company (“Tribune”). The action challenges Tribune’s compliance with an order issued by the Federal Communications Commission (“FCC”) on August 3, 2001, concerning the cross-ownership rules promulgated by the FCC at 47 C.F.R. § 73.3555(d)(3).
