Cleveland Builders Supply Co. v. Farmers Insurance Group of Companies

The Cleveland Builders Supply Company (“CBS”) brought this action against Farmers Insurance Group of Companies (“Farmers”) and insurance agent Glen Silverhart. CBS claimed Farmers had wrongfully denied coverage under an umbrella policy the agent had issued. It sought a declaration of its rights under the policy and damages for various tort claims and breach of contract. Both defendants denied the existence of a contract for insurance. The trial court granted summary judgment to each defendant and this appeal followed.
