THIS MATTER comes before the Court on the Defendant BNSF Railway Company’s Motion to Compel Answers to Requests for Admission, filed May 25, 2011 (Doc. 88). The Court held a hearing on July 6, 2011. The primary issues are: (i) whether the Court should deem admitted certain requests for admission (“RFA”) that Defendant BNSF Railway Company (“BNSF Railway”) propounded on Plaintiffs Emilio J.
