This action was -brought to recover damages for personal injuries alleged to have been sustained by plaintiff through the negligence of defendant. The defendant is an interstate common carrier operating a line of railroad through Utah, Idaho, and other states, and engaged in interstate commerce. The plaintiff was in its employ at or near Pocatello, Idaho. The negligence of defendant is conceded by it. Plaintiff based his right to recover on several grounds.
