TJOFLAT, Chief Judge:

This case involves a challenge to the constitutionality of a municipal ordinance regulating the placement of newsracks on public rights-of-way in the City of Coral Gables, Florida (“the City”). A newspaper publisher contends that the Ordinance is a facially invalid abridgment of the newspaper’s rights of free speech and free press under the First Amendment of the United States Constitution and comparable provisions of the Florida Constitution, as well as a due process and equal protection violation under both the Federal and Florida Constitutions.
