GORTON, District Judge.
Pending before the Court are cross-motions for summary judgment in an adversary proceeding with respect to which the Court has allowed withdrawal of the reference to the bankruptcy court.
I. Background
On September 3, 2003, Attorney Edwin A. McCabe (“the Debtor” or “McCabe”) filed a voluntary petition for relief in the United States Bankruptcy Court for the District of Massachusetts under Chapter 11 of the Bankruptcy Code.
