On November 22, 1899, plaintiffs in the court below filed their petition in the district court for Cedar county, *768Nebraska, asking for a judgment against defendant A. W. Petterson, for goods sold and delivered, in the sum of 8V 095.70. At the same time an affidavit was filed by plaintiffs’ attorney alleging the statutory grounds for an attachment for a debt not due, and also alleging that the defendant was a non-resident of the state of Nebraska.
