Eaton’s case will be considered first.
It is virtually conceded that, if the cut through the ridge had been made by a private land-owner, who had acquired no rights from the plaintiff or from the legislature, he would be liable for the damages *507sought to be recovered in this action. It seems to be assumed that the freshets were such as, looking at the history of the stream in this respect, might be “ reasonably expected occasionally to occur.” The defendants removed the natural barrier which theretofore had completely protected the plaintiffs meadow from the effect of these freshets; and, for…
