FoRd, Judge:

The merchandise under protest herein consists of 2,000 9-volt batteries imported in cardboard display boxes together with 2,000 radios and earphones. The earphones were assessed with duty at the rate of 15 per centum ad valorem under paragraph 353 of the Tariff Act of 1930, as modified by T.D. 51802, and the batteries were assessed with duty at the rate of 17½ per centum ad valorem under paragraph 353 of the Tariff Act of 1930, as modified by T.D. 52739.
