Debra L. Mitchell (“Mitchell”) resigned her position as a medical technologist with Humana Hospital-Shoals (“Humana”) in January 1989. She claims she was constructively discharged in retaliation for her filing with the Equal Employment Opportunity Commission (“EEOC”) a Title VII claim that alleged sex discrimination in Humana’s dress code.
