BREYER, Chief Judge.
The appellant, a subcontractor, brought this lawsuit under the Racketeer Influenced and Corrupt Organizations Act (“RICO”), 18 U.S.C. §§ 1961-1968, against a contractor. The subcontractor claimed that the contractor, by defrauding the federal government in various ways, injured the subcontractor as well as the government. The district court dismissed the suit on the ground that the subcontractor had already litigated its RICO claim in an earlier arbitration proceeding; hence principles of res judicata barred the present action.
