¶ 1 The plaintiff, Kimberli Beaver (Beaver), brought this action in the First Judicial District Court, Lewis and Clark County. The District Court, sitting without a jury, entered Findings of Fact and Conclusions of Law in favor of defendant Montana Department of Natural Resources and Conservation (DNRC) on the issues relating to sexual and marital status discrimination and employment retaliation; in favor of Beaver on the issues relating to civil assault and battery; and in favor of defendant Michael J.
