We collect from the paper books in this case, that on the 16th day of October, 1858, tbe Defendant gave a note, secured by mortgage on real estate in Dodge county, for tbe sum of $272, payable one year from date. That the note and mortgage, by assignment, passed into the hands of the Plaintiff on tbe 31st day of August, 1859. That the Plaintiff foreclosed tbe mortgage by advertisement, and sold the land on tbe 21st day of February, 1860, and became tlie purchaser himself for tbe sum of $341.
