The question submitted to us, upon the argument, is, whether those creditors, who had attached the equitable interest of William Lacón, could, by virtue of their attachments and subsequent levies of execution, acquire such an interest in that property as to be entitled to a proportionate share of the avails of sale as against John Lacón ; in other words, whether an equitable interest is subject to the lien of an attachment, if not completed, by levy of execution, before this legal title is transferred.
