FACTUAL AND PROCEDURAL BACKGROUND

On December 24, 1997, plaintiffs, the Vieques Conservation and Historical Trust (“the Trust”) and Carlos Ventura (“Ventu-ra”), filed this action for declaratory and injunctive relief under the Endangered Species Act (“ESA”), the Federal Water Pollution Control Act (“FWCA”), and the National Environmental Policy Act (“NEPA”).
