I. INTRODUCTION
This is the second motion for summary judgment brought by LTV Corporation and its affiliates (collectively, “LTV” or the “Debtor”) against Frito-Lay, Inc. (“Frito-Lay”). It is related to a prior motion for partial summary judgment heard and decided by this Court, involving essentially the same issues and subject matter. All issues save one were addressed previously in this Court’s opinion and the District Court’s decision on appeal.
