This is an action commenced by R. W. Carruthers, herein referred to as plaintiff, against plaintiff in error, herein referred to as defendant, to recover damages alleged to have been suffered as the results of defendant’s negligence in permitting oil to escape from a pipe line running through the ranch of plaintiff. Plaintiff alleged that 193 head of his cattle drank the water polluted by the oil, and were thereby injured to plaintiff’s damage in the sum of $3,900. Defendant denied generally.
