On Motion for Rehearing.
The appellants, in their motion for rehearing, accuse this court of inconsistency in the original opinion, in that we held in order to maintain the suit that the corporation was dissolved, and that it was not necessary to make parties all the stockholders because the corporation was a party.
[11] In the first place, we did not hold the corporation dissolved. It was alleged in the petition it was dissolved, and that it had lost its corporate identity or forfeited its charter because it had not paid its franchise tax. We held the allegation not sufficient for that…
