This was a suit upon a promissory note, and to foreclose a mortgage given to secure payment of same. The note and mortgage were executed by the defendant in error James TI. Love and Mary A. Love, and made payable to the Union Central Life Insurance Company, of Cincinnati, Ohio, and by it assigned and transferred to W. R. Haines, one of. the defendants in error, who was plaintiff below; the plaintiff in error, S. Á. Horton, and James H. Love and Mary A. Love, being defendants.
