delivered the opinion of the court:

This was a bill brought by Pearl Baughman, a minor, for partition (and to assign dower) of certain lands formerly owned by Sherman E. Baughman, deceased. Pearl Baughman was the only daughter by a second marriage of Sherman E. Baughman, appellants being his children by his first marriage. Appellants not only answered the original bill but filed a cross-bill.
