On December 14th, 1928, George W. Avery filed suit against the Calumet & Jerome Copper Company . on thirty-seven promissory notes aggregating in principal and interest $41,620.02, for $4,160 attorney’s fees, and for the foreclosing of two mortgages given to secure the same, one real, the other chattel. On January 9th, 1929, a default judgment for the amount claimed was rendered, and on May 4th thereafter the defendant’s motion, filed April 4th, 1929, asking that this judgment he set aside, was granted. From this order the plaintiff appeals.
