— Security Trust & Savings Bank, a corporation, hereinafter called plaintiff, brought suit against A. A. Moseley, hereinafter called defendant, fpr a balance of $846.66 due on a promissory note, with interest and attorney’s fees. The complaint was filed May 2, 1923, and the summons personally served on defendant in Yuma county, on May 8th. On May 29th a default was duly entered against him, which he moved to set aside on May 31st.
