This is an appeal to review an order of the court below overruling a motion to vacate a default judgment against the plaintiff in error upon a promissory note and for the foreclosure of a mortgage.

It appears that on February 8, 1923, L. W. Clapp commenced his action in the district court of Seminole county against A. G. May-hue and Ida M. Mayhue, his wife, upon a certain promissory note and to foreclose a real estate mortgage given to secure the same. In said petition, W. E.
