THIS MATTER is before the Court on Defendants’ Motions to Dismiss Plaintiffs Complaint for lack of subject matter jurisdiction and for failure to state a claim. (Dkt. Nos. 6, 8, 17, 46, 57.) This case concerns Plaintiffs claim that Defendants are infringing his Canadian trademark Landcruise, Ltd. {“Landcruise”) used in connection with Plaintiffs motor home rental business. Defendants’ Motions present three issues before the Court.
