MEMORANDUM OPINION AND ORDER

MILLER, Judge.

This case is before the court after trial, during which the court granted defendant’s motion for partial findings under RCFC 52(c) with respect to a claim for financing costs as an element of damages. In order to assert a claim against the Government for breach of the implied duty of good faith and fair dealing, plaintiff sought to set aside a release of all of its claims executed in 1996.
