Appeal from an order of the Family Court of Albany County (Tobin, J.), entered September 9, 2003, which, inter alia, dismissed petitioner’s application, in a proceeding pursuant to Family Ct Act article 4, to modify a prior order of child support.

*1027Pursuant to a September 1998 written stipulation between the parties, petitioner is obligated to pay respondent—based upon his anticipated annual income of $45,000—$1,000 per month in child support for their three children, born in 1989, 1991 and 1993.
