Defendant’s assignments of error relate to his sentencing. Defendant contends he is entitled to a new sentencing hearing because (1) his original sentence was imposed in violation of G.S. 15A-1334, the defendant’s right to due process of law, his right to counsel, as guaranteed by the sixth and fourteenth amendments to the United States Constitution and Article I, § 19 of the Constitution of the State of North Carolina; and (2) the court erred in failing to sentence him as a committed youthful offender under G.S. 15A-1340.4(a) or find on the record that he would not benefit from…
