ORDER

BRITT, Chief Judge.

On 3 September 1986 the Secretary of Labor brought this suit pursuant to the Employee Retirement Income Security Act (ERISA), 29 U.S.C. §§ 1001 et seq., seeking to enjoin acts and practices which violate the provisions of Title 1 of ERISA, and to obtain other appropriate relief.

In his complaint plaintiff alleged that the defendant, William W. Gillikin, breached his fiduciary obligations as a trustee of an employee benefit plan by failing to discharge his duties with respect to that plan solely in the interest of the plan participants and beneficiaries, for the…
