In the five-count complaint filed to commence this action, plaintiff John Duffy (“Duffy”) alleged that Daniel Grinder (“Grinder”) was involved in a motor vehicle accident on May 12, 2005, and sought and received chiropractic medical treatment by Duffy beginning February 21,2006. Grinder was insured by defendant Commerce Insurance Company (“Commerce”) under a standard Massachusetts automobile insurance policy that provided personal injury protection (“PIP”) benefits.
