Our former opinion is withdrawn and the following is the opinion of the Court:

This is a suit brought by respondents, Walton et al against petitioner, Luther Transfer & Storage, Inc. for damages resulting from flood damages done to merchandise plaintiffs had stored in the warehouse belonging to defendant. The warehouse was situated in a low area of the City of Lubbock, Texas.
