On October 8, 1910, ap-pellee filed this suit against the. Merchants’ Life Association of Burlington, Iowa, for $2,000, alleged to be due him upon a life insurance policy upon the life of Nat B. Jones, deceased, payable to Fay T. Jones, appellant, and joined appellant in the suit, alleging that she claimed some interest in the policy. Appellee alleged that on October 8, 1909, said Nat B. Jones by a written instrument transferred and assigned .said policy to appellee, thereby substituting appellee for appellant as beneficiary.
