In March 1965 Melvin Warshaw (not a party to the instant case), as president of Bankhead Estates, Inc. (“Bankhead”), executed the first of a series of promissory notes and deeds to secure debt in favor of appellee Georgia Federal Bank (formerly known as Atlanta Federal Savings & Loan Association and hereinafter referred to as “bank”). Only the first loan was the subject of the litigation underlying the instant appeal.
