The district court for Morrill County sustained cross-motions for summary judgment and dismissed the petition of Stanley E. Krul, Jr., for damages (bodily injury and property) and the counterclaim of Sterkel Farms, Inc., for property damage, arising from an automobile-truck accident. The accident occurred shortly before 10 a.m. on January 8, 1983, near an intersection of a private driveway and an east-west gravel road in Morrill County. Weather was not a factor in the accident.
