Butler appeals from the judgment of conviction of the charge of having lottery tickets in his possession in .violation of N.M.1929 Comp.St.Anno., § 35-3804, which reads as follows: “Whoever shall write, print, vend, or have in possession with intent for himself or another, to sell or offer to sell, negotiate, exchange or dispose of any ticket, share of a ticket, or any writing, certificate, token or device, purporting or intending to entitle the holder, bearer or any other person, to any prize, or any share of or interest in any prize, to be drawn in any lottery,…
