ERICKSTAD, Judge.

This is an appeal by the plaintiff, Peter Sittner, from a judgment entered April 23, 1965, in the District Court of Sioux County, in favor of the defendant Clara Mistel-ski. Trial de novo is demanded.

By summons and complaint dated June 29, 1963, served upon the defendants in July and August, 1963, the plaintiff brought an action to quiet title to the Southwest Quarter of Section 27, Township 129, North of Range 90, West of the Fifth Principal Meridian, situated in Sioux County, North Dakota.
