Appellant was tided upon an information filed against him on the 5th day of September, 1893, in the superior court of Thurston county, for the crime of murder in the first degree, committed by killing one J. S. *524McCabe, on the 3d day of August, 1893. The trial resulted in a verdict finding the appellant guilty of murder in the second degree. Motions in arrest of judgment and for a new trial 'were made and overruled by the court, and the court sentenced the appellant to imprisonment in the penitentiary for a period of fourteen years.
