2Per curiam

This case was referred to Trial Commissioner Roald A. Hogenson with directions to make findings of fact and recommendation for conclusions of law. The commissioner has done so in an opinion and report filed on August 16, 1965. Plaintiff requested the court to adopt the trial commissioner’s findings of fact with certain additions and excepted to his recommendation for conclusions of law. Defendant requested that the court adopt both the findings of fact and the recommended conclusions of law. The case was submitted to the court on the briefs of the parties and oral argument of counsel.…
