OPINION AND ORDER

CEDARBAUM, District Judge.

This diversity action was originally brought by now-decesaed George B. Rooney against his former employer, the Witco Corporation, alleging intentional infliction of emotional distress and retaliation in violation of New York Executive Law § 296. Rooney’s widow and executrix of his estate, Marion L. Rooney, has continued the action on her husband’s behalf. Discovery is complete, and Witco has moved for sum mary judgment. For the reasons discussed below, the motion is granted.
