On October 23, 1963, plaintiff filed a complaint to establish paternity; on February 21, 1966, judgment of dismissal without prejudice to refiling was entered. On plaintiff’s motion to vacate judgment of dismissal under section 473, Code of Civil Procedure, order was made on May 18, 1966, Amcating the judgment only upon performance within 30 days by plaintiff of certain conditions precedent, i.e., payment of $1,000 to attorneys for defendant and full and detailed response to Interrogatory No. 31.
