This matter is before the court on cross-motions for summary judgment addressing the same issue, the validity of an indemnity clause in the parties’ contract for “general maintenance repairs.” The suit was brought by LTV Steel Company, Inc. [“LTV”], the indemnitee, to enforce the clause. Defendants Northwest Engineering & Construction, Inc. and its division J. Hilding Johnson [collectively, “Northwest”], contend that an Indiana statute voids the clause. The parties agree that no material facts are in dispute.
