DECISION

HODGSON, Chief Judge:

For sometime the appellant suspected, with apparent good reason, that his wife was having an affair with George Freeman, a co-worker at a janitorial service firm where she worked. About a week before her death, the appellant told a friend that if it were true about Freeman and his wife, “somebody could get hurt.” The appellant also stated that if his “[wife] could make him angry enough, he would pick her up and throw her across the yard.” The day before his wife’s demise, the appellant telephoned Freeman and told him that “when he got through with [his wife],…
