This case involves the construction of the will of Clotworthy Birnie which was executed in March, 1845, shortly before his death. He left a few articles of personal property to his son, Clotworthy, stating that he had received his full portion of the estate, and his pistols and bullet moulds to his son, Rogers, and then gave and devised to his daughter, Margaret, as executrix, and to his son, Rogers, as executor, and to the suryivor of them, etc., all his real, personal and mixed estate (except the articles bequeathed to his son), subject to the payment of his debts and funeral expenses, “in…
