MOORE, J.
Javier Doroteo Chavez was charged with receiving stolen property (Pen. Code, § 496, subd. 1) and grand theft of an automobile (Pen. Code, § 487h, subd. (a).) It was also alleged defendant had suffered a prior term of imprisonment for robbery pursuant to Penal Code section 667.5, subdivision (b).
After a jury trial, defendant was acquitted of receiving stolen property but convicted of grand theft of an automobile. Defendant waived a jury as to the prior term of imprisonment allegation, and the court found the allegation to be true. Defendant was sentenced to state prison for a…
