FOLLMER, District Judge.

This case was tried before the Court and without a jury, with judgment in favor of the plaintiff. 93 F.Supp. 505. Defendants have moved for a new trial and judgment N.O.V.

Counsel for defendants commence their brief with a tirade upon the insurance situation in Missouri. There is no evidence pertinent thereto in this action, nor is it material.1 Suffice it to say that defendants did choose to issue a considerable number of policies on property, both real and personal, in Missouri.
