BOWES, J.:

¶ 1 Gilbert Lee Fowler appeals' the twenty-to-forty-year term of imprisonment imposed after he pleaded guilty to third degree murder. We affirm the judgment of sentence and defer a claim of ineffective assistance of counsel to collateral review.

¶ 2 On September 3, 2003, Appellant tendered a guilty plea to third degree murder. The terms of the plea agreement were set forth on the record: “The Commonwealth has agreed [to withdraw] the general count of criminal homicide, defendant is entering a plea to murder of the third degree.
